Burdette Indicted 


 

Burdette Indicted on 19 counts

    Cary "Allen" Burdette was indicted on 19 counts some of which he has been charged with Theft of Property 1st degree. 
    
Burdette, who currently resides on Cavern Road in Trussville was incarcerated Tuesday April 14 following notice of the Indictment. 
    
He was held by Jefferson County on a bond of $100000 and released April 15.
    
In May of 2008 Burdette filed a law suit against Clay News and Editor Tina Tidmore after she continued to publish articles that included claims from area residents.  The claims ranged from non-payment of promissory notes to loans on funds that reportedly he received while doing business as an attorney. 
   
According to recent published reports by Clay News, Count three of the indictment claims Burdette used a “device, scheme or artifice to defraud” investors, then used that money “to pay previous investors and other personal or non-related expenses.”
   
Four of the counts are 1st degree theft of property charges, a class B felony. The indictment claims the alleged Theft was using deception to obtain funds, more than $2,500 in each case.
    According to Alabama Securities Commission attorney Ed Reed, each of these theft charges carry a possible 20-year sentence.  The indictment also includes 13 counts of fraud in connection with the sale of a security, a class C felony. Each of these, Reed said, carries a possible 10-year sentence.  
    According to Clay News, the indictment claims that Burdette made untrue statements in issuing securities. It claims Burdette told some of the investors their money would be used in condominium developments in Fairhope, Gulf Shores and Biloxi, Mississippi. In some cases, the indictment claims Burdette said the investor money would be used in business ventures including Regional Nuclear Pharmaceuticals, Alan Burdette Investments and Infinity Business Group.
  Other charges Burdette is facing includes issuing a security without a license and issuing an unregistered security. As for more charges or possible other arrests coming, Reed would not comment because it is an ongoing investigation. 
    Tina Tidmore, Editor of Clay News when asked about the case said, "I was just doing my job".
    Her attorney Dennis Bailey told the News that he said he hopes that Burdette will voluntarily drop the case. He said  that if Burdette, who is no longer represented by legal council in the case against Clay News, does not voluntarily drop the suit, he plans to file another motion 10 days before a scheduled May 7 hearing that would give the judge the opportunity to dismiss the case against Clay News.
